Smoke Free Policy for Pakenham Bowls Club
- APPLICATION
1.1. This Pakenham Bowls Club (PBC) Policy is binding on all members, employees,
players, coaches, officials, spectators, visitors and contractors of PBC.
1.2. Accordingly, the following Policy has been developed by PBC to enable members,
employees, players, coaches, officials, spectators, visitors and contractors of PBC to
participate in the game of bowls in a smoke-free and alcohol responsible
environment. - PHILOSOPHY
2.1. PBC recognises that exposure of non-smokers to environmental tobacco smoke is
hazardous to health and that non-smokers should be protected from this. Legislation
and duty of care requirements stipulate the need for a smoke-free environment.
2.2. Under common law Pakenham Bowls Club has a duty to ensure that members,
employees, players, coaches, officials, spectators, visitors and contractors are not
exposed to potentially harmful situations.
2.3. Federal, State and Local Government Legislation requires workplaces to be
compliant and to minimise risk to the health of any person. - INTERPRETATION
3.1. Unless the context otherwise requires, the terms, “the green” and “Bank” shall have
the same meaning as in the Laws of the Sport of Bowls Crystal Mark 3rd Edition,
Version 3.1, April 2019.
3.2. For avoidance of any doubt, electronic cigarettes (E-Cigarettes/vaporisers/vaping)
are considered a form of tobacco smoke and are included under this Policy. - SMOKE-FREE AREAS
4.1. The following areas shall be smoke-free at all times:
4.1.1. the green;
4.1.2. the bank;
4.1.3. all indoor areas;
4.1.4. all enclosed outdoor areas;
4.1.5. all outdoor dining areas that are defined by our boundary fence;
4.1.6. the entry bridge, please keep thoroughfare clear at all times;
4.1.7. within four(4) metres of any building entrance, or in accordance with Federal,
State or Local Government Legislation.
4.2. Clause 4.1 shall apply to any member, player, official, spectator, visitor or any other
person, whether or not acting in an official Pakenham Bowls Club capacity.
4.3. No person acting in any Pakenham Bowls Club capacity shall smoke in a vehicle if a
child under the age of 18 is present at the time. - PENALTIES
5.1. The following penalties shall apply to anyone who is a registered bowler found to be
in breach of clause 4 of this Policy during any other time.
5.1.1. First Occurence
5.1.1.1. The person will be advised by the Pakenham Bowls Club of the Policy
and the requirement to adhere to its contents.
5.1.2. Second Occurrence on the day
5.1.2.1.The visitor will be warned again, with a letter from Pakenham Bowls Club
to the offender’s club requesting that that club deal with the member
flagrant violation of Pakenham Bowls Club rules.
If the offender is a member of Pakenham Bowls Club that member will be
subject to a disciplinary hearing.
5.1.3. Third Occurrence on the day
5.1.3.1.The bowler whether visitor or member of Pakenham Bowls Club will be
asked to leave the club premises immediately.
5.2. The following penalties shall apply to anyone who is not a registered bowler found to
be in breach of clause 4 of this Policy during any time.
5.2.1. First Occurence
5.2.1.1. The person will be advised by the Pakenham Bowls Club of the Policy
and the requirement to adhere to its contents.
5.2.1.2. Second Occurrence on the day
5.2.1.2.1.
The visitor will be asked to leave the club immediately and a record
kept of the visitor’s name.
- REPORTING
6.1. All complaints should be reported to the Pakenham Bowls Club Board.
